Terms of Service

These Terms govern your use of JobPunch, a workforce time-tracking service operated by South Bend IT Solutions LLC (d/b/a South Bend IT Services) ("we", "us", "JobPunch"). By creating an account, you agree to these Terms.

1. Your account

You are responsible for keeping your password secret and for all activity on your account. You must be at least 18 years old and authorized to enter into a contract on behalf of any business you sign up.

2. What you can use JobPunch for

You may use JobPunch to track time worked by employees of a business you own, manage, or are authorized to administer. You must comply with applicable wage-and-hour laws, employee notice laws, and employee consent laws in your jurisdiction — especially around GPS tracking and photo-on-punch features.

4. Free, paid, and trial usage

The Free plan is free up to 5 active employees per business, indefinitely. Paid plans (Pro and Business) are billed monthly or annually in advance via Stripe. You can downgrade at any time; you will not be refunded for the unused portion of a paid period.

5. Billing

Per-employee fees are based on your active employee count, recalculated at most once per hour and applied prorated to your next invoice. SMS-related fees may be charged for usage above the included allotment for your plan.

Automatic payment (autopay). Paid plans require a valid payment method kept on file. By subscribing you authorize us to automatically charge that method for your recurring fees (and any applicable usage or late fees) each billing period until you cancel. We may change prices with advance notice; price changes take effect at your next renewal.

Late fees. If a charge fails, we will retry it. If your invoice remains unpaid more than 10 days past its due date, a one-time $5 late fee may be added to your account, and continued non-payment may result in suspension of the service until the balance is paid.

6. Cancellation

You may cancel at any time from the Stripe Customer Portal. Your data is retained for 90 days after cancellation in case you reactivate; after that we permanently delete it.

7. Service availability

We aim for high uptime but do not guarantee any specific level of service availability. Brief outages may occur for maintenance, internet issues, or unexpected failures. We will not be liable for losses you incur due to service unavailability.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you under these Terms shall not exceed the amount you paid to JobPunch in the 12 months preceding the claim. We are not liable for any indirect, consequential, or punitive damages, including lost profits or lost data, even if we were warned of the possibility.

10. Indemnification

You agree to indemnify and hold South Bend IT Solutions LLC harmless from any claim brought against us by your employees, contractors, or third parties arising from your use of JobPunch — including but not limited to claims that you tracked an employee without proper notice.

11. Governing law

These Terms are governed by the laws of the State of Indiana, USA. Any dispute will be resolved in the state or federal courts located in St. Joseph County, Indiana, and you consent to that jurisdiction.

12. Changes

We may update these Terms from time to time. We will post the new version at jobpunch.app/terms and email account owners at least 14 days before any material change takes effect. Continued use after the effective date is acceptance of the new Terms.
